Xamany Terms & Conditions
These Terms explain how to use Xamany during Beta: what the platform does, what sellers and buyers must follow, and how payments, delivery and issue reporting currently work.
Beta version: 2026-09-beta1·Effective date: 20 September 2026 (2026-09-beta1, 2026-09-20)
1. About Xamany
Xamany is a commerce platform and set of workflows, available through WhatsApp and web surfaces. Xamany helps sellers and buyers organise a sale; Xamany is not the manufacturer, the stockist, or — unless explicitly stated for a given service — the courier for the order.
Xamany may help with:
- product discovery;
- shop management;
- orders;
- checkout;
- payment initiation;
- delivery and receipt evidence;
- issue reporting;
- seller / customer communication;
- marketplace workflows.
Xamany does not own seller inventory, manufacture products, physically deliver every order, guarantee seller performance, or provide insurance or escrow, unless such a service is explicitly implemented and described as such.
2. Eligibility and account use
You must be able to enter a contract and provide accurate information to create or use a Xamany account.
You may use Xamany as a buyer, seller, or both, depending on the features available.
You are responsible for keeping your password confidential and for use of your account.
3. Seller use of Xamany
Sellers must:
- provide accurate business and shop information;
- list products and services honestly;
- show correct prices;
- fulfil accepted orders;
- comply with the Xamany Marketplace Rules;
- respond to genuine customer issues;
- avoid misuse of delivery confirmation;
- avoid asking for the delivery code before delivery;
- comply with applicable law.
Seller-specific policies cannot override the Xamany Marketplace Rules or applicable mandatory rights.
4. Buyer use of Xamany
Buyers must:
- provide accurate order and delivery information;
- use legitimate payment methods;
- report genuine issues honestly;
- avoid false claims or evidence;
- keep delivery codes private until receipt;
- comply with the Xamany Marketplace Rules.
5. Listings, products and services
Listings are created by sellers. Xamany may display products, prices, photos and descriptions supplied by the seller.
A seller must describe products and services accurately, disclose material limitations, and keep availability reasonably current.
Xamany may remove or restrict a listing in cases of abuse, apparent illegality, or harm to platform integrity. That is not a promise of exhaustive moderation.
6. Orders
A Xamany order records what was agreed through the platform: items, quantities, displayed price, delivery or pickup method, and the recipient details provided.
Accepting an order creates an obligation for the seller to fulfil it according to the recorded information, subject to availability, payment and applicable law.
Xamany records the order; Xamany does not buy the item from the seller or resell it to the buyer, unless explicitly stated for a given service.
7. Payments
Payment methods may be provided by third-party payment providers. Availability depends on country, provider and payment method. Xamany does not promise universal card support, universal Mobile Money support, or seller transfers where those are unsupported.
Xamany may use transaction splitting or other provider-supported settlement models. Payment status shown in Xamany is based on provider confirmation.
Xamany does not promise instant settlement, a guaranteed payout timeline, or that every payment attempt will be accepted.
8. Delivery and pickup
Delivery or pickup is organised according to the method agreed for the order. Unless explicitly stated otherwise, Xamany is not the courier.
Depending on the order, Xamany may record: the handed-to-driver timestamp; seller completion; delivery-code confirmation; customer receipt confirmation; an optional delivery photo; the order timeline.
Delivery evidence is factual evidence. It does not automatically prove that the correct item, condition or quantity was supplied.
“I received it” records that the buyer confirmed receipt. It does not waive the right to report an eligible product problem.
The delivery code is not a legal signature. It helps confirm that a delivery interaction took place. It should only be shared when receiving the order.
9. Buyer–seller issues and Marketplace Rules
Use of the Xamany marketplace is also subject to the Xamany Marketplace Rules and Buyer Protection process.
These Terms do not repeat those rules in full. When an issue is reported, buyer and seller use the Xamany workflow: report, seller response, attempted resolution, then Xamany review if needed.
Xamany does not automatically decide a dispute outcome. Delivery evidence, a code, a photo or a receipt confirmation is a piece of information, not an automatic decision.
10. Refunds and reversals
A refund may be appropriate in some cases. Issue resolution may result in an agreed refund.
Actual refund or reversal availability may depend on the payment provider and the transaction state.
Xamany’s current issue workflow does not automatically execute refunds. Xamany does not promise automatic refunds, guaranteed reversals, or a guaranteed refund timeline.
11. WhatsApp and communications
Xamany uses WhatsApp as a core interaction channel, alongside web surfaces.
Users are also subject to WhatsApp / Meta terms where applicable. Xamany does not control WhatsApp availability.
Messages may be delivered through WhatsApp. Some notifications depend on WhatsApp session or template rules. Delays or limitations may occur because of third-party platform restrictions.
12. Seller WhatsApp Business coexistence
Connecting a seller’s WhatsApp Business app is optional.
If connected: Xamany may process customer messages arriving on that business number; the seller may continue using WhatsApp Business; Xamany may receive platform-provided message or history events where permitted.
Xamany does not guarantee access to every WhatsApp feature or to every historical message.
Catalogue import is a separate action. Connecting WhatsApp Business does not automatically import products.
13. Prohibited misuse
You must not use Xamany for:
- fraud;
- fake listings;
- false delivery evidence;
- false claims;
- impersonation;
- abusive or illegal products or services;
- attempts to manipulate payment or order status;
- misuse of Xamany systems.
This section states Beta rules. It does not introduce automated enforcement.
14. Suspension and restriction
Xamany may restrict access where necessary for security, fraud prevention, abuse, legal or regulatory reasons, or platform integrity.
Restriction is a platform-protection measure. It is not, at this stage, an automated process described in these Terms.
15. Data and privacy
Personal data is handled according to the Privacy Policy.
These Terms do not repeat that policy. For cookies, retention, providers and your rights, see the Privacy Policy.
16. Changes to the service
Xamany is in Beta. Features may be added, changed, limited or withdrawn.
Availability may also depend on third-party providers, including WhatsApp and payment providers.
17. Changes to these Terms
When we update these Terms, we publish the new version and its effective date. Where appropriate, we may ask you to accept the updated Terms.
18. Liability and limitations
During Beta, Xamany provides a platform and workflows. To the extent permitted by applicable law, Xamany is not responsible for seller acts, the quality of seller products or services, delays or failures of third-party providers, or unavailability of WhatsApp or a payment provider.
Nothing in these Terms is intended to exclude liability that cannot be limited under applicable law.
Governing law and dispute jurisdiction are not settled in this Beta version; they are left for later legal review.
